The SCLA Claims Conference and Designation Reception, presented by American Educational Institute and The Society of Claim Law Associates, provides claims law education and recognition. The conference also provides opportunities to network with other claims professionals who share similar concerns and challenges.

The educational program is designed to help claims professionals sharpen their skills, enhance their productivity, and stay current on the latest industry developments.

This is also the conference where new AEI designees are recognized for their achievements. Claims professionals are recognized for having achieved a Specialist Designation, an Associate Designation, and the “ultimate in claims law professionalism” – the Senior Claim Law Associate (SCLA) Designation. Silver and Gold Award recipients are also recognized.

Who Should Attend: In addition to claims professionals who are being recognized for having achieved AEI’s Claims Law Designations and Awards, claims executives, managers, investigators, and frontline adjusters from insurance carriers and independent adjusting firms will benefit from the conference. Participation is not limited to SCLA members or AEI designees – all insurance claims professionals are invited to participate. Dress Code: Except for the Conferment Ceremony and Designation Reception on Saturday evening, the dress code is business casual. Business attire for men and women is appropriate for the Conferment Ceremony and Designation Reception.

REGISTRATION

Current dues-paid members of the SCLA are eligible for the reduced conference registration fee. And, if the registration and payment are received on or prior to August 1, 2012, the “early bird” rate also applies.

If you are not presently a dues-paid member of the SCLA, but you are eligible to become one (you are eligible to become a member of the SCLA if you have earned any of the claims law designations offered by American Educational Institute), you may pay your membership dues in conjunction with your conference registration. SCLA dues are $60 per year. Dues-paid members are eligible for the reduced conference registration fee and all of the other member benefits.

The conference registration fee includes all educational sessions, conference materials, Thursday evening Welcome Reception, two continental breakfasts, four refreshment breaks, and the Saturday evening Designation Reception, Conferment Ceremony, and Dinner.

The conference guest fee includes the Thursday evening Welcome Reception, two continental breakfasts, and the Saturday evening Designation Reception, Conferment Ceremony, and Dinner. Guest fee functions cannot be purchased separately.

Conference I.D. Badges: All conference attendees are required to check in at the Conference Registration Desk that will be located in the Hyatt Regency Hotel. When you check in, you will receive your conference I.D. badge and a badge for your guest, if you registered and paid for a guest. The conference I.D. badge must be worn for admission to all conference functions including the Thursday evening Welcome Reception that is scheduled to begin at 6:00 pm and end at 8:00 pm. Although the Conference Registration Desk will be open on Friday, October 5 and Saturday, October 6 (see hours of operation below) it is recommended that you check in at the registration desk as soon as possible, preferably on Thursday, October 4 between the hours of 4:00 pm and 8:00 pm.

Substitution and Cancellation Policy:

Registration Fees: If after having registered, you are no longer able to attend, you may substitute another person at any time prior to the conference at no additional cost. If you must cancel and you do so in writing on or prior to August 1, 2012, you will receive a registration fee refund, less a $50 administrative fee. Registrants who do not provide written notice of cancellation on or prior to August 1, 2012 are responsible for the entire conference registration fee (fee is not refundable nor transferable to any subsequent SCLA Conference).

Whatever the reason, if the SCLA cancels the conference, neither AEI nor SCLA shall be responsible for any airfare or other costs incurred by registrants and guests in preparation for attending the conference. However, if the SCLA cancels the conference, all registration fees shall be fully refunded.

Hotel Cancellations: The SCLA will cancel hotel reservations made on conference registration forms before the hotel cut-off date (August 31) for any registrant who provides the SCLA with written notice of cancellation. After the hotel cut-off date (August 31), registrants themselves may cancel or modify their room reservation by directly calling the hotel at (415) 788-1234. If a room reservation is canceled within three days of the registrant’s expected arrival, the registrant will not incur any liability for the canceled hotel reservation. Otherwise, the registrant’s credit card on file will be charged for one night at the rate that was booked plus taxes.

CONFERENCE HOTEL

The SCLA Annual Claims Conference and Designation Reception will be held in the Hyatt Regency Hotel, Five Embarcadero Center, San Francisco, California, 94111. The only AAA Four Diamond downtown San Francisco hotel situated right on the Embarcadero waterfront. Guests will enjoy immediate access to both the Financial District and the city’s most famous attractions. Hotel Reservations: Make your hotel reservation at the special SCLA Conference rate of $239 + tax (single and double occupancy) per night, by completing the Hotel Reservation section of the Conference Registration Form. The special conference room rate is available through August 31, 2012; after that, room reservations will be accepted based on availability at the prevailing rate. Additional persons will be charged at a rate of $25 per person, per night, with a maximum of four persons per guestroom. Children under eighteen stay free in their parent’s guestroom. Do not make your hotel reservation directly with the Hyatt Regency – hotel reservations must be made in conjunction with your Conference registration with the SCLA. You may confirm your hotel reservation beginning on or after August 31 by calling the hotel directly at (415) 788-1234. Although the Hyatt Regency Hotel will be provided with your credit card information, your card will not be charged until you arrive. However, your card will be charged for one night at the rate booked + taxes if you do not cancel within three (3) days of your expected arrival.

Seminars: Six claims law education seminars are scheduled beginning on Friday morning, October 5, and ending on Saturday, October 6. All of the seminars are general sessions and will take place in the Hyatt Regency Hotel. Conference registrants are encouraged to attend the seminars as there is ample time in the program to relax and explore San Francisco and the surrounding area. Registrants will receive a raffle ticket for each of the six seminars and the appropriate ticket will be collected at the end of each seminar. Two raffle drawings will take place on Saturday, October 6 immediately after the last seminar – the first winner will receive a $200 American Express Gift Check and the second winner will receive a $100 dollar American Express Gift Check. Seminar: “Burn Baby Burn”: Hollywood Helps Adjusters Deal With Claimants Who Make Arson Claims, presented by Erwin E. Adler, Esq., Adler Law Group, Los Angeles. Arson has been a longstanding problem for insurance carriers. A prompt and cost effective investigation is necessary and if the investigation substantiates arson, issues of coverage and bad faith must also be addressed. Mr. Adler will discuss recent changes in the methods of investigating fire claims and evolving doctrines to protect carriers from subsequent bad faith claims. The presentation will be highlighted by clips from various motion pictures.

Seminar: Handling Policy Limit Demands in Third Party Cases, presented by Michael M. Pollak, Esq., Pollak, Vida & Fisher, Los Angeles. In a third party claim, the claimant’s attorney may give the insurance carrier a demand to settle for the policy limit proceeds. Sometimes the demand has time limits and conditions. Under the law, if an insurance carrier unreasonably fails to accept a policy limit demand, it is liable for the entire judgment against the insured, irrespective of the policy limits. Claimant’s attorneys have become sophisticated in “opening” policy limits. This presentation will show the types of demand letters that are being sent and how insurance professionals can best respond to them.

Speaker: Michael M. Pollak, Esq. Michael Pollak is the managing partner of Pollak, Vida & Fisher, Los Angeles. Mike defends insurance bad faith cases brought against the firm’s insurance clientele and also represents clients in, among other work, insurance coverage, summary judgment motions, and new trial motions. Mike received his law degree from the University of California at Davis in 1979 and was admitted to the California Bar that year. Seminar: Reservation of Rights Letter: Purpose, Preparation, and Pitfalls of Failing to Prepare, presented by Matthew J. Sekits, Esq., Bullivant, Houser, Bailey, Seattle. The importance of the insurance company’s reservation of rights letter should not be under estimated. An improperly crafted letter can result in the waiver of coverage defenses and increase the chances of being exposed to extra-contractual liability. This seminar will focus on how to prepare reservation of rights letters, including a checklist of helpful reminders.

Mr. Sekits is a trial lawyer who focuses his practice on defending and prosecuting cases on behalf of corporate clients, including insurance companies, in complex commercial litigation. Seminar: Top Ten Reasons Employers Get Sued (And What to Do About Them), presented by Michael A. Patterson, Esq. Patterson Buchanan Fobes Leitch & Kalzer, Inc., P.S., Seattle. Attendees will learn and understand: (1) what the data show about claims filed against employers; (2) the top ten situations and practices that can make employers more susceptible to litigation, each will be illustrated with real life examples; and (3) best practices for preventing such claims and for mitigating potential exposure where they are not prevented.

Speaker: Michael A. Patterson, Esq. Mr. Patterson is the Senior Principal and President at Patterson Buchanan Fobes Leitch & Kalzer, Inc., P.S., a Pacific Northwest law firm with offices located in Seattle, Washington and Portland, Oregon. With the growing status of social networking via technology (Facebook, Twitter, texting, and email), supervisory and claims challenges continue to grow due to a lack of definitive legal authority and an understanding of the risks. This presentation is designed to provide updates on legal developments and standard of care. Best practices and realistic strategies for minimizing incidents arising from social media will be highlighted, as well as ways to address inappropriate use, cyberbullying, and electronic harassment. Future areas of possible exposure will also be discussed.

Seminar: The Claims Professional & Defense Counsel Relationship – A Team Effort, presented by William K. Bennett, Esq. Nationwide Mutual Insurance Company, Trial Division, San Diego. This seminar will address the fundamentals of litigation management with a focus on the claims professional’s relationship with defense counsel. It’s important to understand the responsibilities that each party has in the litigation process and the team effort required to achieve desirable and efficient results. This seminar will be interactive with opportunity for questions and answers.

Speaker: William K. Bennett, Esq. Mr. Bennett has been involved with insurance defense work for over 35 years. He has been staff counsel for Fireman’s Fund Insurance Company, Allstate Insurance Company, and is currently the Regional Attorney for Nationwide Mutual Insurance Company, responsible for California and Nevada. In this capacity, Mr. Bennett leads seven managing attorneys and 41 trial attorneys. He received a B.A. from Emory University in 1973 and a J.D. from Stetson College of Law in 1976, and was admitted to the Florida Bar in 1976.

Welcome Reception: Conference registrants, their paid guests, seminar speakers, and sponsors are invited to enjoy cocktails and hors d’ oeuvres at the Welcome Reception on Thursday evening, October 4, between 6:00 and 8:00 pm. Relax, have a cocktail, some hors d’ oeuvres, and meet your colleagues. The Welcome Reception will take place in the Hyatt Regency Hotel. Conference I.D. badges will be required for admission.

SCLA Annual Meeting: SCLA members are encouraged to attend the SCLA Annual Meeting to learn about the administration of the Society. All meeting attendees will be included in a raffle drawing for a very enticing prize. You must attend the meeting to be eligible to win. The SCLA Annual Meeting will take place on Saturday morning, October 6 at 8:30 am in the Hyatt Regency Hotel and will last no more than 30 minutes. The first Saturday morning educational seminar will immediately follow the SCLA Annual Meeting.

DESIGNATION CONFERMENT

Designation Conferment: The Designation Conferment will take place in the Hyatt Regency Hotel on Saturday evening, October 6, 2012, beginning at 6:30 pm. The designee’s registered spouse or guest is encouraged to attend. AEI designees and Silver and Gold Award recipients recognized at the conference include those who achieved a designation or award between August 1, 2011 and August 31, 2012. A cocktail reception begins at 6:00 pm (drinks and hors d’ oeuvres) and the Conferment Ceremony begins promptly at 6:30 pm. Dinner immediately follows the Conferment Ceremony.

New SCLA Designee – 2012 Class Representative, $1,000 Award: Anyone achieving the SCLA designation between August 1, 2011 and August 31, 2012 is eligible to be the 2012 SCLA Class Representative. The class representative will address the new designees during the Conferment Ceremony at the Conference. The duration of the talk should be a minimum of 10 minutes and a maximum of 15 minutes. And the subject of the talk should be the impact of the SCLA designation in your work. For instance, you could talk about how what you have learned has helped in your claims work, or how your designation has given you more confidence in dealing with attorneys. The class representative will be chosen based on the text of the proposed speech submitted before the conference. And the chosen designee will receive a cash award of $1,000 along with a complimentary registration for two. The chosen designee will be responsible for their own travel and hotel expenses.

Interested designees must possess strong public speaking skills. And they must submit a letter of recommendation from their manager attesting to those skills along with a typed copy of the presentation no later than September 7, 2012. Designation Reception and Dinner: You’ve done the work, you’ve successfully completed the examinations, you’ve earned the designation – now it’s time to celebrate! The Designation Reception and Dinner is about celebrating your achievement with your spouse or guest – no speeches, just cocktails, dinner, and plenty of fun. Have a good time – you’ve earned it! A cocktail reception begins at 6:00 pm (drinks and hors d’ oeuvres) and the Conferment Ceremony begins promptly at 6:30 pm. Dinner immediately follows the Conferment Ceremony. The cocktail reception, Conferment Ceremony, and dinner will all take place in the Hyatt Regency Hotel.

SPONSOR OPPORTUNITIES

Nine sponsor opportunities are available. Sponsors receive company recognition in the conference program, along with signage at the selected function and a copy of the conference registration list. One conference registration is included with a $1,000 sponsorship and two conference registrations are included with the $1,500 sponsorship. All conference sponsor functions will take place in the Hyatt Regency Hotel. Select one of the sponsor opportunities listed below. Only one sponsor per function will be accepted - sponsor opportunities will be accepted on a first-come, first-served basis - so act quickly.

    Thursday Welcome Reception - $1,000: Conference registrants and their paid guests are invited to enjoy cocktails and hors d’oeuvres at the Welcome Reception on Thursday evening, October 4, 2012, between 6:00 pm and 8:00 pm. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the conference program, a conference registration list, and one complimentary conference registration.

    Friday Continental Breakfast - $700: Conference registrants will be provided with continental breakfast on Friday morning, October 5, between 8:00 am and 9:00 am. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the conference program and a conference registration list.

    Friday Refreshment Break – $500: Conference registrants will be provided with two refreshment breaks on Friday morning, October 5: the first between 10:30 am and 10:45 am and the second between 11:45 am and 12:00 noon. The sponsor for these two functions will receive prominent signage at the entrance of the ballroom along with recognition in the conference program and a conference registration list.

    Saturday Continental Breakfast - $700: Conference registrants will be provided with continental breakfast on Saturday morning, October 6, between 8:00 am and 9:00 am. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the conference program and a conference registration list.

    Saturday Refreshment Break – $500: Conference registrants will be provided with two refreshment breaks on Friday morning, October 6: the first between 10:30 am and 10:45 am and the second between 11:45 am and 12:00 noon. The sponsor for these two functions will receive prominent signage at the entrance of the ballroom along with recognition in the conference program and a conference registration list.

    Saturday Seminar Raffle – $1000: Registrants will receive a raffle ticket for each of the six seminars and the appropriate ticket will be collected at the end of each seminar. Two raffle drawings will take place on Saturday, October 6 immediately after the last seminar – the first winner will receive a $200 dollar American Express Gift Check and the second winner will receive a $100 dollar American Express Gift Check. Registrants must be present at the drawing to win. The raffle sponsor will pick the winning tickets, hand out the prizes, receive prominent signage at the entrance of the ballroom along with recognition in the conference program, a conference registration list, and one complimentary conference registration.

    Saturday Designation Reception – $1,000: Conference registrants and their paid guests are invited to enjoy cocktails and hors d’oeuvres on Saturday evening, October 6 at a cocktail reception from 6:00 pm – 6:30 pm. The Conferment Ceremony follows promptly in the same ballroom at 6:30 pm. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the conference program, a conference registration list, and one complimentary conference registration.

    2012 SCLA Class Representative – $1,000: The class representative will address the new designees during the Conferment Ceremony on Saturday evening, October 6. The selected designee will be chosen based on the text of his/her proposed speech submitted before the conference. And the selected designee will receive a cash award of $1,000 along with a complimentary conference registration for two. The sponsor of the 2012 SCLA Class Representative will present the designee with the $1,000 award immediately following their presentation at the Conferment Ceremony on Saturday evening, October 6, receive prominent signage at the entrance of the ballroom along with recognition in the conference program, a conference registration list, and one complimentary conference registration.

    Saturday Designation Dinner – $1,500: Conference registrants and their paid guests are invited to dinner and cocktails immediately following the Conferment Ceremony on Saturday evening, October 6 – this function ends at approximately 10:00 pm. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the conference program, a conference registration list and two complimentary conference registrations.
