About this Conference

The SCLA Claims Conference and Designation Reception, presented by American Educational Institute and The Society of Claim Law Associates, provides claims law education and recognition.

The educational program is designed to help claims professionals sharpen their skills, enhance their productivity, and stay current on the latest industry developments. Sessions will be presented by noted legal and technical experts on subjects of critical importance to claims professionals.

This is also the conference at which new AEI designees are recognized for their achievements. Claims professionals are recognized for having achieved a Specialist designation, an Associate designation, and the “ultimate in claims law professionalism” – the Senior Claim Law Associate (SCLA) designation. Silver and Gold Award recipients are also recognized.

This conference also provides opportunities to network with other claims professionals who share similar concerns and challenges.

Who Should Attend

In addition to claims professionals who are being recognized for having achieved Claims Law Designations and Awards, claims executives, managers, investigators, and adjusters from insurance carriers and independent adjusters will benefit from this conference. Participation is not limited to SCLA members or AEI designees – all insurance claims professionals are invited to participate. You’ll be joined by claims professionals from leading insurance companies across the country

The conference provides quality claims-relevant education, and the schedule also includes opportunities to explore the conference city. Most participants bring their spouse or a guest. In addition, the Welcome Reception, Conferment Ceremony, and Designation Reception are conference functions particularly suited to spouse/guest participation. Registration Fees

2008 dues-paid members of the SCLA are eligible for the reduced conference registration fee. And, if the registration and payment are received on or prior to August 15, 2008, the “early bird” rate also applies.

If you are not presently a dues-paid member of the SCLA, but you are eligible to become one (you are eligible to become a member of the SCLA if you have earned any of the professional designations offered by American Educational Institute), you may pay your membership dues in conjunction with your conference registration. SCLA dues are $60 per year. Dues-paid members are eligible for the reduced conference registration fee and all of the other member benefits, including an annual subscription to Claims magazine. An annual subscription to Claims magazine is $72, but you receive twelve issues of Claims plus all of the other member benefits for only $60.

The conference registration fee includes all educational sessions, conference materials, Thursday evening Welcome Reception, two continental breakfasts, two refreshment breaks, and the Conferment Ceremony and Designation Reception (includes dinner and cocktails) on Saturday evening.

The conference guest fee includes the Thursday evening Welcome Reception, and the Saturday evening Conferment Ceremony and Designation Reception (includes dinner and cocktails). Guest fee functions cannot be purchased separately.

Conference I.D. Badges

All conference attendees are required to check-in at the Conference Registration Desk that will be located in the foyer of Essex South, third floor of the Westin Hotel. When you check-in, you will receive your conference I.D. badge and a badge for your guest, if you registered and paid for a guest. The conference I.D. badge must be worn for admission to all conference functions including the Thursday evening Welcome Reception that is scheduled to begin at 6:00 pm and end at 8:00 pm. Although the Conference Registration Desk will be open on Friday, November 14 and Saturday, November 15 (see hours of operation below) it is recommended that you check-in at the registration desk as soon as possible, preferably on Thursday, November 13 between the hours of 1:00 pm and 5:00 pm.

Seminars

Six claims law education seminars are scheduled beginning on Friday morning, November 14, at 9:00 am, and ending on Saturday, November 15 at 12:00 noon. All of the seminars are general sessions and will take place in the Staffordshire Room, third floor of the Westin Hotel.

Friday, November 14

9:00 am - 10:30 am
Speaker: Erwin E. Adler, Esq. Erwin is a founder of the Adler Law Group, Los Angeles, CA. Erwin received his J.D. from Harvard Law School and an LL.M. from the University of Michigan, and has authored and published articles on various insurance issues. His expertise focuses on coverage issues as well as litigating bad faith claims. Mr. Adler has been a speaker at almost every SCLA Claims Conference since its inception–and his presentations have always been well received.

Seminar: Avoiding Bad Faith Issues in Settlement Discussions. Negotiating settlements of pending claims can be a trying exercise in itself. When, however, those settlement discussions are undertaken in the context of a policyholder claiming a carrier is acting in bad faith if it fails to satisfy the insured’s demands, the exercise can become a daunting challenge. With examples from various Hollywood films, this seminar will demonstrate how to achieve a fair settlement and also avoid bad faith liability.

Speaker: Michael Cheiftz, Esq. Michael D. Chefitz is a Senior Partner at Bonner Kiernan Trebach & Crociata, LLP and heads up the firm’s coverage practice. Mr. Chefitz is a 1981 graduate of Brandeis University and a 1984 graduate of Boston University School of Law. Mr. Chefitz’ practice concentrates on representing insurance companies in insurance coverage and extra-contractual matters and in defending policyholders and self insureds in claims involving products liability, asbestos, construction litigation, premises liability, and liquor liability. Mr. Chefitz is admitted to the state and federal bars of Massachusetts and Rhode Island and has appeared in coverage matters in numerous jurisdictions across the country. Mr. Chefitz works out of the Boston office of Bonner Kiernan Trebach & Crociata, LLP. This seminar will be conducted by a panel of four attorneys – all from the law firm of Bonner Kiernan Trebach & Crociata: Michael Chefitz, Andrew Butz, William White, Jr., and Alexander Gillespie.

Seminar: A Fresh Look at an Old Remedy: Using Declaratory Judgment Actions to Resolve Claims. There is increasing pressure upon claims professionals to resolve claims at as early a stage as possible. Declaratory Judgment actions can be used as a means not only to determine whether there is coverage where coverage is uncertain, but also as a device to resolve claims altogether. Moreover, the mere filing of a coverage action will serve as a defense to a bad faith claim in several jurisdictions. This seminar will discuss the panel’s experiences in this regard and make recommendations on the effective use of declaratory judgment actions.

11:45 am - 12:30 pm
Speaker: Matthew J. Sekits, Esq. Mr. Sekits is a shareholder in the law firm of Bullivant Houser Bailey, Seattle, WA. He earned his J. D. from the University of Washington School of Law and his B.A. from the University of California at Berkeley. Mr. Sekits is a litigator and trial lawyer whose practice focuses on defending corporate clients, including insurance companies in complex commercial litigation.

Seminar: The Do’s and Don’ts of Third Party Claim Handling. Unlike contract damages, tort damages recoverable in bad faith actions are not limited to the amount due under the policy. Rather, the insured can recover damages for all losses caused by the carrier’s misconduct. In third party cases, tort damages include the amount of any judgment against the insured that exceeds the policy limit, as well as other damages such as emotional distress. This seminar will focus upon third party claim handling, including the do’s and don’ts of the claim investigation, a good faith policy checklist, and other substantive recommendations to help avoid extra-contractual liability.

Saturday, November 15

Speaker: Michael L. Markushewski. Mr. Markushewski is the Vice President of Engineering at ARCCA, Inc., Boston, MA. He earned a B.S. in Mechanical Engineering Technology from Philadelphia’s Spring Garden College and attended Pennsylvania State University for graduate courses in Engineering Science. Mr. Markushewski is highly qualified as a crashworthiness engineer. He has established a distinctive career in the field of crashworthiness, occupant crash protection, emergency escape, crash safety and survival, and life support engineering. His extensive experience focuses on research, design, test, and evaluation of aircraft and vehicular seating systems, restraint systems, inflatable restraints, ejection seats, crashworthy seating systems and protective devices. As a result of his in-depth knowledge and experience, Mr. Markushewski is a recognized leader in the field of crashworthiness and occupant protection.

Seminar: Injuries Sustained in Low Speed Impacts: Fact or Fiction? A Bio-Mechanical Injury Analysis. The human body is more tolerant of impacts from the rear than any other direction. However, a disproportionate number of injury claims as a result of rear-end collisions are reported. The potential for injury is partially related to occupant interaction with the design of the automobile, but also depends greatly on the force of the impact. While certain injuries are possible from these types of collisions, oftentimes the claimed injuries are unrelated to the crash. This Power-Point presentation with embedded videos explores the various aspects of low speed impact injuries. An examination of accident reconstruction, vehicle design, and bio-mechanics of this type of crash will be presented. Case studies, crash tests, and medical literature will be reviewed to demonstrate what injuries are consistent with low speed impact, and why certain claimed injuries may not be related to the mishap.

Speaker: W. Joseph Flanagan, Esq. William Joseph Flanagan is a partner in the law firm of Morrison Mahoney, LLP, Boston, MA. Joe is a trial lawyer who specializes in civil litigation defense and is a member of the Massachusetts and New Hampshire bars. Mr. Flanagan is a 1982 graduate of Boston College and a 1990 Magna Cum Laude graduate of New England School of Law where he was an editor of the Law Review. Joe has litigated and tried numerous product liability, professional liability, construction, premises liability, and transportation cases. He has also defended insurers in bad faith and extra-contractual litigation, has lectured on the subject, and has authored numerous articles in insurance trade publications.

Seminar: Investigate to Win. Mr. Flanagan will discuss how to plan and implement a claim investigation designed to win at trial. Although dispute resolution is typically preferred before trial begins, a properly planned investigation can help to achieve an early settlement. In situations when that is not possible, however, a properly planned investigation can also improve your chances of winning at trial. Mr. Flanagan will address investigative techniques to avoid and those that will help to achieve an equitable claim resolution. Topics include preservation and spoliation of evidence, effective surveillance, and controlling witnesses.

Speaker: Andrew Butz, Esq. Andrew Butz is a partner at Bonner Kiernan Trebach & Crociata, LLP, and conducts a complex litigation and appellate practice. Mr. Butz is a 1966 graduate of Princeton University and a 1976 graduate of the Georgetown University Law Center. Mr. Butz’s practice concentrates on representing insurance companies and self insured’s in claims involving insurance coverage and reinsurance matters, as well as business torts, construction and municipal liability, government contracts and general liability defense. Mr. Butz is admitted to the state and federal bars in the District of Columbia, Virginia and Illinois and has appeared in coverage and other matters in numerous jurisdictions around the country. Mr. Butz works out of the Washington, D.C. office of Bonner Kiernan Trebach & Crociata, LLP. This seminar will be conducted by a panel of four attorneys – all from the law firm of Bonner Kiernan Trebach & Crociata: Andrew Butz, William White, Jr., Alexander Gillespie, and Michael Chefitz.

Seminar: When is a Lie Sufficient to Deny Coverage? The Misrepresentation Defense. This seminar will address the elements that generally must be established in order to raise misrepresentation as a coverage defense to a first-party claim. The seminar will discuss whether specific intent to defraud must be established or whether negligent misrepresentation will suffice. The panel members will also discuss their experience in using the misrepresentation defense to assist in prevailing upon other first-party coverage defenses.

Continuing Education (CE) Credits: We will only seek continuing education credit from those states in which conference registrants express an interest. Registrants can note their interest in continuing education credit from specific states on the conference registration form. Conference registrants, their paid guests, seminar speakers, and sponsors are invited to enjoy cocktails and hors d’ oeuvres at the Welcome Reception on Thursday evening, November 13, between 6:00 and 8:00 pm. Relax, have a cocktail, some hors d’ oeuvres, and meet your colleagues. The Welcome Reception will take place in the Staffordshire Room, third floor of the Westin Hotel. Conference I.D. badges will be required for admission.

Breakfast with Your Regional Vice President

Membership in the Society is divided into four regions–Northeast, Southeast, Central and Western. Each of these regions is represented by a Regional Vice President. On Friday morning, November 14, between 8:00 am and 8:45 am, you are invited to have breakfast with your Regional Vice President. This is an opportunity to network with colleagues and share ideas about how the Society can serve you better. Unlike the SCLA Annual Meeting, this is a more informal gathering. Tables in the Staffordshire Room, third floor of the Westin Hotel will be designated for each of the four regions. The states that make up each of the four regions will be designated in the Conference Program for your convenience. Opening Remarks and the first educational session will immediately follow breakfast in the Staffordshire Room.

SCLA Annual Meeting

SCLA members are encouraged to attend the SCLA Annual Meeting to learn about the administration of the Society. All meeting attendees will be included in a raffle drawing for a very enticing prize. You must attend the meeting to be eligible to win. The SCLA Annual Meeting will take place on Saturday morning, November 15 at 8:45 am in Essex South, third floor of the Westin Hotel and will last no more than 15 minutes. The first Saturday morning educational session will immediately follow the SCLA Annual Meeting in the Staffordshire Room.

Designation Conferment Ceremony

The Designation Conferment will take place in the Essex South Ballroom, third floor of the Westin Hotel on Saturday evening, November 15, 2008, beginning at 6:30 pm. The designee’s registered spouse or guest is encouraged to attend. AEI designees and Silver and Gold Award recipients recognized at the conference include those who achieved a designation or award between August 1, 2007 and September 30, 2008. A cocktail reception begins at 6:00 pm (drinks and hors d’ oeuvres) and the Conferment Ceremony begins promptly at 6:30 pm. Dinner immediately follows the Conferment Ceremony.

New SCLA Designee – 2008 Class Representative, $1,000 Award

If you achieve the SCLA designation between August 1, 2007 and September 11, 2008, you are eligible to be the 2008 SCLA Class Representative. The SCLA Class Representative will receive a cash award of $1,000 along with a complimentary conference registration for two. The selected designee will address the new designees at the Conferment Ceremony on Saturday evening, November 15. The duration of the talk should be a minimum of ten minutes and a maximum of 15 minutes. The substance of the talk should be the significance of the SCLA designation to you. For example, you could talk about how what you have learned has helped you in your claims work, or how your designation has given you more confidence in dealing with attorneys.

Interested designees must posses strong public speaking skills and submit a letter of recommendation from their manager attesting to those skills, along with a typed copy of the presentation no later than September 12, 2008. Designation Reception

You’ve done the work, you’ve successfully completed the examinations, you’ve earned the designation – now its time to celebrate! The Designation Reception is about celebrating your achievement with your spouse or guest – no speeches, just cocktails, dinner, and plenty of fun. Have a good time – you’ve earned it! A cocktail reception begins at 6:00 pm (drinks and hors d’ oeuvres) and the Conferment Ceremony begins promptly at 6:30 pm. Dinner immediately follows the Conferment Ceremony. The cocktail reception, Conferment Ceremony, and dinner will all take place in the Essex South Ballroom, third floor of the Westin Hotel.

Dress Code

Except for the Conferment Ceremony and Designation Reception on Saturday evening, the dress code is business casual. Business attire for men and women is appropriate for the Conferment Ceremony and Designation Reception.

Substitution and Cancellation Policy

Registrants may send a replacement/substitute at any time prior to the conference at no additional cost. Those submitting written notice of cancellation on or prior to August 15, 2008 will receive a full refund, less a $50 administrative fee. Individuals who do not attend or who do not cancel prior to August 15, 2008 are responsible for the entire conference fee (fee is not refundable nor transferable to any subsequent SCLA Conference). Conference registrants who cancel their conference registration with the SCLA must also adhere to the terms of the hotel cancellation policy. The SCLA is not responsible for cancelling your hotel reservation – you are.

Sponsor Opportunities: Six sponsor opportunities are available. Sponsors receive company recognition in the Conference Program and the Designation Conferment Program, along with signage at the selected function and one complimentary conference registration. Only one sponsor per opportunity or function will be accepted – sponsor opportunities will be accepted on a first-come, first-served basis, so act quickly.

Conference Padfolio with Company Logo - $1,500: Each conference registrant will receive a padfolio with your company logo. The padfolio will be included in the conference bag distributed to all registrants at the conference. This sponsor opportunity requires the submission of your company logo by September 12, 2008. Art work requirements and submission instructions will be mailed upon receipt and acceptance of the Sponsor Registration. The sponsor of the padfolio will also receive one complimentary conference registration.

Thursday Welcome Reception - $1,000: Conference registrants and their paid guests are invited to enjoy cocktails (2 hour open bar) and hors d’oeuvres at the Welcome Reception on Thursday evening, November 13, 2008, between 6:00 and 8:00 pm. Saturday Continental Breakfast and Refreshment Break - $800: Conference registrants will be provided with continental breakfast and a refreshment break on Saturday morning, November 15 between 8:00 am and 9:00 am and 10:45 am and 11:00 am respectively. Continental breakfast and refreshment break stations will be setup in Essex South, third floor of the Westin Hotel, which is also the location for all other conference functions including all educational seminars. The sponsor for these functions will receive prominent signage at the entrance of the ballroom along with recognition in the conference program and one complimentary conference registration.

Saturday Designation Conferment Ceremony - $1,000: The Designation Conferment Ceremony is designed to recognize new AEI designees and Silver and Gold Award recipients. The ceremony will take place in the Staffordshire Ballroom of the Westin Hotel on Saturday evening, November 15, 2008, beginning at 6:30 pm. The designee’s registered spouse or guest is encouraged to attend. The Designation Reception will immediately follow the ceremony. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the Designation Conferment Program (distributed to all attendees on Saturday evening, November 15), and one complimentary conference registration.

Saturday Evening Designation Reception - $1,500: Conference registrants and their paid guests are invited to enjoy cocktails and hors d’ oeuvres at a ½ hour cocktail reception beginning at 6:00 pm in the Staffordshire Ballroom. The Conferment Ceremony follows at 6:30 pm and dinner immediately follows the Conferment Ceremony. The sponsor for this function will receive prominent signage at the entrance of the ballroom along with recognition in the Designation Conferment Program (distributed to all attendees on Saturday evening, November 15), and one complimentary conference registration.

2009 SCLA Annual Claims Conference and Designation Reception: The 2009 Conference will take place in Scottsdale, AZ. The conference is typically scheduled between late September and early November. The hotel and specific dates will be announced after the 2008 Boston Conference.
